The introduction of the Goods and Services Tax (GST) in India was part of a nationwide effort to create a unified tax system, replacing multiple indirect taxes with a single tax structure. The process began with the 122nd Constitutional Amendment Bill, which was passed by Parliament in August 2016, paving the way for GST implementation. Following the national framework, the Andhra Pradesh government enacted the APGST Act on June 30, 2017, to align state taxation with the new GST regime. The Act came into effect on July 1, 2017, coinciding with the nationwide rollout of GST.

Brief Background

In response to the need for a more efficient tax system, the Andhra Pradesh government implemented the Value Added Tax (VAT) system on April 1, 2005. This move was part of a nationwide shift toward VAT to modernize tax administration. While Goods and Services Tax (GST) in 2017 altered the landscape of indirect taxation in India, APVAT continues to function on certain goods not covered under the purview of the Goods and Services Tax (APGST) Act, 2017.

Objective

Service tax was introduced in India through the Finance Act, 1994, initially covering just three services: telephone services, paging services, and certain services provided by the government. Over the years, the government expanded the scope of service tax to include a wide range of services, reflecting the growth of the service sector.

Benefits

By 2012, the negative list approach was adopted, meaning all services were taxable unless explicitly exempted. This act has been repealed with the introduction of the Goods and Services Tax (APGST) Act, 2017.

Implementation Methodology

To mobilize additional resources and address the revenue shortfall resulting from tax exemptions for hotels with an annual turnover of up to Rs. 2 lakhs, as well as to impose taxes on higher income groups, the Andhra Pradesh Tax on Luxuries in Hotels and Lodging Houses Act was enacted in 1987.
